Ive been in a contract with a software company for 2 years

Resolved Question:

I've been in a contract with a software company for 2 years now and when I asked when my cortract was due for renewal, they said it automatically renews every 2 years unless I give them 3 months notice. They didn't inform me of this and now the contrat rolls over for another 2 years. Can they do this?

Is this a maintenance/support type contract?

Customer: It a licence to use the software.

Okay. Do their terms and conditions allow for automatic renewal like this? If not, then they simply cannot automatically renew if you do not give appropriate notice. The contract would be for a fixed term only.

If there are auto renewal provisions these are permissible clauses and are legally enforceable.
