Can I take action against the hospital who stated I would receive treatment within a 12 week period, and have failed to do so ?

I am still awaiting treatment and in considerable pain, having received initial emergency treatment in July of this year

The 12 week timescale is I believe a statute which was passed by the Scottish Government, and is stated in a letter which I received from the health board, after emergency treatment.
