he allso refusin to forward my p45.
This likely amounts to an unlawful deduction from wages, which is made illegal under the Employment Rights Act 1996.
Under law, an employer can only make deductions from, or withhold an employee’s wages in the following circumstances:
If none of the above exemptions apply, the deductions will most likely be unlawful. In order to try and resolve this, the employer should be contacted in writing, advised that this is being treated as unlawful deduction of wages and ask them to pay back the money within 7 days. Advise them that if they fail to pay the money that is owed, legal proceedings could follow.
If the employer does not return the money as requested, the following options are available:
Hopefully by warning the employer you are aware of your rights and are not going to hesitate taking further action they will be prompted to reconsider their position and work towards resolving this.
As to the P45 you cannot force them to send you this but if you cannot get it from them you can contact the Revenue and advise them and they can issue as replacement or provide you with other documentation which you can use instead.
Hope this clarifies your position? If you could please let me know that would be great, thank you
thankyou for your advise, how much would a solisitors letter forwarded to my ex employer cost me please ...
it can vary, depending on who you get, how much detail they put in, if they spend much time with you at first getting to understand the situation. To be honest you do not need a solicitor to write a letter you can do that yourself, there is no legal requirement to get a solicitor involved at any stage of the process and it will considerably keep the costs down
ok thankyou ill get on it right away and hopefully he will see the light and pay the wages .... thankyou for advise mike holt
you are welcome, all the bestv
