Apprenticeship breach of contract. My son was wrongfully dismissed

Customer Question

apprenticeship breach of contract. My son was wrongfully dismissed after 8 months into his first year apprenticeship without due process, in his contract it said he would get a verbal, written warning followed by a formal dismissal with 1 week's notice. He was told that he was a retarded, spastic and other such 'defamation of character' was used to oust him out and was sacked whilst working away by phone call. His contract clearly states after his 3 month probation period he would be given 1 week's notice after due process (verbal followed by written & formal dismissal). Also David (18 years) was assaulted whilst on site working and was grabbed by his genitals - this has only come to light since he spoke to me (his mother) on returning from working off site. Do i have a case for breach of contract/defamation of character & assault?

Hello, my name is ***** ***** it is my pleasure to assist you with your question today. Did the employer actually conduct a dismissal hearing?
Customer: replied 2 years ago.

Hi Ben, No the employer did not conduct a dismissal meeting with my son, just told him by phone that he had been warned verbally but David did not understand what it was he was doing wrong - having worked away and not under mentorship for 5 weeks. He was actually told he was doing a great job by the client and mentor who sacked him by phone had just bought him new tool kit 7 days earlier.
