I have a carer employed through an agency. She has given notice to the agency and I would like to employ her privately but there is a clause in my contract which states that I will be liable for a placement fee of £1500. There is no time limit stipulated for this. Would this be legally binding?
I don't know if this is relevant but the agency have not kept to their own terms as I should have received at least 14 days notice of an increase in fees recently but I received no notice at all.
I would be grateful if you could advise me abiut this.
