Shared ownership legal rights when one partner wants to leav

Customer Question

My son and his girlfriend have bought a 46% share in a shared ownership scheme through a housing association. The girlfriend now wants to separate and leave the property, is my son entitled to stay in the property by himself?

Hi
Thank you for your question.
My name is Clare
I will do my best to help you but I need some further information first.
How much is there share worth and how much is outstanding on the mortgage?
Can he get the mortgage company to release his ex?
Clare
Customer: replied 2 years ago.
They have a mortgage of a £68,000 and we provided a deposit of £12k
I think the total value of the property was £180k.
They is most they could borrow on their wages. We are worried Bromford Housing would say if one partner leaves the other person would also have to leave even though we would help my son financially with the rent

We have the contract schedule,
Leaseholders covenants, landlords covenants, provisos,Langland and tenant covenants act 1985 declaration

Hi
It should be in the Housing Association Documentation - look in the Leaseholders Covenants first - and take your time I will be here tomorrow!
Clare
Customer: replied 2 years ago.

Customer: replied 2 years ago.
Under leaseholders covenants it includes

3.2 interet
3.3 insurance premiums
3.4 outgoings
3.5 repair

Etc etc

What am I actually looking for

Hi
Not there then.
Look at the original offer documentation - where they detailed the requirements.
Clare
I will ask Customer services to talk to you about scans!
