My wife wants me to leave our home when I made her adultery

Customer Question

My wife wants me to leave our home when I made her adultery public. The house and mortgage are in her name. She is currently in the process of remortgage. I want to work on marriage she does not. My contributions through joint account are minimal to bills/council tax although I have always helped with home improvements etc. What are my rights and options?

Hi
Thank you for your question.
My name is Clare
I will do my best to help you but I need some further information first.
How long have you lived together?
How much is the property worth and how much is outstanding on the mortgage
What other assets and debts are there and what income do you each have?
Clare
Customer: replied 2 years ago.

Married 6 years, lived together 8 years. Awaiting valuation but probably just under 200k . Remortgage is for 154k. Initial mortgage was 125k extra funds to be used to pay back her Mother. Her Mother has a charge on property as she lent us 50k to buy. In the remortgage the wife is paying this back. Debts about 5k each on credit cards, she earns 40k pa me 25kpa. second hand cars only real assets apart from about 2k I have tied up in share save scheme.

Hi
My apologies for the delay - sadly you fell off my list when you relisted the matter
How was the original purchase financed and why was the property purchased in her sole name?
Clare
Customer: replied 2 years ago.
Original purchase made with funds from sale of her flat we had lived together in for 4 years and additional funds loaned from her mother. Purchase made in wifes name. Mother has land charge registered so no sale can be made without her ok

Hi
How much is outstanding on the EXISTING mortgage
What offer has your wife made?
Clare
Customer: replied 2 years ago.
Existing mortgage, I'm not sure what's outstanding. But was 125 taken out 2 years ago. Wife has offered me 5 to walk now or divorce if I stay
Expert:  Clare replied 2 years ago.
Hi
So for clarity the house is worth £200,000 and there is (maybe) £125,000 on the mortgage and £50,000 owed to her mother.
You have lived together for 8 years and the original deposit came from your wife.
Your ex has offered you a 20/80 split of the equity
Is that about right?
Clare
Customer: replied 2 years ago.
Probably more like 60 to her mother and each have 5 on credit cards but yes
Expert:  Clare replied 2 years ago.
Hi
So she has offered y0u basically a 65/35 split on the house?
