How long does one have to be separated from a wife or husband before divorce becomes automatic when applied for ? My son and wife have been separated for nearly four years

In England after two years separation, a spouse can apply for divorce with the other's consent, five years without consent. In Scotand two years with consent, one year without.
The court has to be satisfied that all matters involving children and finances have been resolved.

Is there a set fee for applying for a divorce after 5 years ?

There are no children and there is no property, There are no financial

issues either way.

That applies to England. The fee is less in Scotland.
