Customer Question

I am a stepfather to two disable boys and one daughter. What legal rights do I have if my wife passes away? More in the case of my sons.

Thank you for your question.
Your wife should make a will appointing you as guardian with parental rights so as to comply with the legislation on this which you can see here:
http://www.legislation.gov.uk/ukpga/1989/41/section/5
She should see a solicitor so that this is done properly as it is of the utmost importance to both of you.
I hope this helps. Please leave a positive response so that I am credited for my time.

HiUnfortunately if the father has Parental Responsibility for the children being named as a Testamentary Guardian will NOT give you Parental Responsibility until the father dies. There are a number of other possible options, but in order to fully answer your query I would need to know the ages of the children and what contact they have with their fatherClare
