how old is the child and is there any reason?
Customer: replied 2 years ago.

she is 8 and she just wants to be with dad as he lives inn Birmingham and she only sees him at weekends and holidays -- we live in long eaton

I am afraid at that age the court would expect the chid to return to the primary carer at the end of the holiday. If the dad wanted to apply to the court for the child to live with him then he would need to make an application to the court for a child arrangement order.Happy to discussPlease rate positively

what if dad refuses to bring her back?

Expert:  Thomas Judge replied 2 years ago.
Without safeguarding reasons then the mother would make an urgent application (if so advised) for a recovery order. This would make things difficult going forward for the contact which Dad has.
