Customer Question

Please advise: I want to know where my daughter stands with regards ***** ***** marital home and family support financially. their Marital home is under both hers and her husbands names. however his father had put down a heavy deposit (250.000 I think). my daughter has put a very small amount of savings (17,000 I think!) towards the deposit. My daughter has been married for 2.5 years, (lived with him and his family for approximately 2 years prior to getting married but they had bought the property approximately 4-5 years and stayed at his parents until they had done it up. they have a 16 months old son and she is currently 3 months pregnant. her husband comes from a fairly wealthy family. she was asked by him and family to give up her career (to which she had studied and worked very hard for) once she had her baby to take care of him. she was happy to do so also. However, her husband have always shown signs of temper, severely controlling her every move, who she speaks to and what she says and most importantly what ever money she is aloud to have or spend, obsessed and verbally very very abusive towards her, this could go on for days and sometimes weeks once he gets in this mood. and then he can switch and be overly nice to her and don't think twice about spending over his means on gifts to her, not because he is sorry for what his done or said or how much he made her suffer, as he would never in a million years admit to that but just to show her how generous he is and how grateful she should be and also tell everyone else how much money he just spent on her. currently the situation is getting very serious as my daughter is very much emotionally distraught, fragile, weak in health and emotional wreck, about 6 months ago, she was 2 months pregnant and passed out from exhaustion and under nourished, then weeks later miscarried. it seems as the marriage is possible and very much likely to be break down.

Hello
Welcome to Just Answer
I am a Solicitor and will assist.
I am very sorry to hear about the difficulties that your daughter is experiencing.
Please may I ask:
- what is the house value?
- was the payment by his parents a gift?
- any deed of trust in respect of the payment by his parents?
- do you know what the other matrimonial assets are? I'm including pensions?
- what is the husbands earning capacity?
- has he been physically violent?
- is divorce contemplated?
Kind regards
Caroline
Ps it may take me a short while to respond as I am just going to start my travel home
