My grandparents divorced and remarried.Their daughter, my aunt

Resolved Question:

my grandparents divorced and remarried.Their daughter, my aunt has recently died intestate.Do the children and grand children of their new marriages inherit from her estate, or will my father as the only surviving son inherit?

My aunt had no children and was a widow

Thank you. As she has no surviving husband, or any children or grandchildren her biological parents will inherit her estate in equal shares. If they are not alive then her brothers and sisters (biological) will inherit in equal shares. If any of her siblings have passed away then their children will inherit in their place.Relatives by marriage are not entitled to inheritance under intestacy rules.

Does this mean that my dad as the only surviving child of my grandparents first marriage would inherit all, or does his half sister of his dad's second marriage inherit too? We have recently learnt that his mum had one child in her second marriage, another half sister, now dead, who has two living sons and on grandchild, are they able to claim from the estate?

I forgot to say that my dad was the only sibling to have children

Have both your father's biological parents passed away? Does your father have any siblings who have passed away, and if they have do they have children? His half-sisters and their children will not be entitled to inheritance.

Both my dads parents are dead, .he had an older brother and sister who are both dead, one being the aunt whose estate I am sorting out for him. Neither my aunt or uncle had children.
