Hi,I am here on a tier 2 ICT long term staff. I came here in 2015 Aug. My wife came to UK as a Tier 2 ICT dependent in 2016. She is currently working in the UK. She now has an employer who is willing to sponsor her tier 2 general visa. The process has not yet started. What i am trying to find out is, does the employer have to offer her a restricted CoS or an unrestricted CoS?

A​ Tier 2(ICT) dependant cannot switch into a Tier 2 (General) while in the country. You wife must leave the UK and make her Tier 2 (General) application. For this reason and if she will be paid less than £159,600, she must be assigned a restricted CoS

Thank you. What would happen if her company assigns an unrestricted CoS. Will she be able to apply with an unrestricted CoS from home country?
