1. A garda has the power to arrest without warrant under the Mental Treatment Acts any person who is considered a danger to themselves or to others. Accordingly, if the Gardai see an individual in the street who wants to kill themselves, they should be immediately arrested and taken to a secure unit for treatment under the Mental Health Acts.
