we had a seware leak on our land from a disuesd pipe pooring neat sewage onto our land

there is a train line that runs along our land, neat sewage was pooring down the embankment onto our land, southern water after about 4 weeks found the leak was from a dissused pipe so was not there fault.

we lost a pregnent mare and 2 foals, the vets said it was more than lickly that the mare had kidney failer and a foal was born with defects and the other was stillborn due to the sewage but like every thing we cannot prove it. we spent a small fortune on had food as we could not take a chance on lossing any more, the man hours put in was astronomical and food etc, for 3 months untill we where told it is safe to use our land again, the department for the enviroment was not interested as long as the sewage was not going into a stream.

are southern water liable? if so what can we do about it?

I presume that Southern Water are saying they do not maintain the pipe and never have done?

southern water said that as the pipe is dissused it is not there problem, but one of there workers ( clancy docwra ) said it is.
