I have a dispute with my neighbour over a wooden boundary fence

Customer Question

I have a dispute with my neighbour over a wooden boundary fence which has fallen into our garden. The neighbour days the boundary is our responsibility, whereas a cursory check with our Deeds confirms it is definitely his responsibility. We have written to him pointing this out, together with a copy drawing illustrating his responsibility.
Should he refuse to accept responsibility what legal redress do we have to enforce a replacement boundary fence?
Are we able to finance the replacement fence, and then enforce repayment through the Small Claims Court?
