I dont understand, if the Duchy of Lancaster manages to register the rights to the mines an minerals for the land underneath my house, Can they ever make me sell my house , or take it from me if they need to gain acess to the mines and minerals? They land registry did not accept my objection as I did not give enough grounds! As I said, i didnt really understand it so did not know the proper grounds to object on?
In landlaw, you own everything above your house as far as the heavens and everythingbelow your house down to the centre of the earth, although obviously, it wouldtaper to an infinitely small dot at the centre of the earth.
Itis extremely common for all mineral rights to be excluded from the title to ahouse.
Ifthe Duchy of Lancaster decided there was something valuable under your house. This would give them the right to mine it.
Thechances of new mine workings happening are remote and it's not something that Iwould be the least bit bothered about. If your house subsides you are entitledto compensation and if they decide to open cast on the surface, where yourhouse is they would be forced to give you full market value plus compensation.
Tobe honest, objecting is a waste of time.
Iwould also not lose one moment sleep over this.
Mylast three houses have had mines and the mineral rights Excluded.
The nextpart is really important for me:
