I got sn interims contact order where the wording is ambigious.

Customer Question

I got sn interims contact order where the wording is ambigious. Can I ask the court for clarification or do I need to file a contact order if I don't think it says what we agreed. The child birthday falls on the father's weekend and it was agreed that the child would be returned the night before his birthday and the father compensated with another day. But now the father claims that is not the case

We discussed the birthday and the the respondent's solicitor suggested and further contact details to arranged between the parties. He wants to claim the extra day, but not return for the birthday which is in two weeks. I am wondering if I need to go in with another emergency application. Dates are not mentioned in the order. I could face believed that we agreed to it

Hi
Have you spoken to his solicitor about what you believed had been agreed?
Claire
Customer: replied 3 years ago.

No. If they don't agree to what I believe was agreed. Is the way forward a new contact order as time is critical or an appeal against the current order as it is a few minor changes.

Hi
Was the birthday issue actually discussed before the Judge?
Why was it not put in the order?
Claire
Customer: replied 3 years ago.
Yes it was discussed. And it was mentioned how to compensate the dad. I suggested the dad could have him on the Thursday to compensate for the birthday. His solicitor interrupted and suggested to put in "such further contact as the parties may agree" . The dad still insists on the Thursday even though the date is not mentioned but doesn't want to give the Sunday.
I am planning to write a letter to the court and clarify the ambiguities. Am i allowed to so. I have a current residence order application. Can I attach to that specific issues like the birthdays for future or do I need another order?

Hi
The starting point is to write a letter to his solicitor setting out what was agreed at court and asking them to confirm this in writing.
Say that unless you hear by Friday you will ask the court for an emergency hearing for a specific issue order regarding the birthday contact.
have the application ready to go and ask for an urgent hearing - and within the application set out that you had believed this had been settled at the last hearing
