Hi, welcome to Just Answer. I will help you with your question.
Has the Court made an order allowing the Council to take the property back? Have you been removed from the property?
Helen is still living in the property. The Brent Partnership gave NOTICE TO QUIT until 28 feb 2013. If Helen did not quite the property on 28 Feb 2013, the manager of the TMO office of Watling Gardens, Paul, threatened to issue legal proceedings against Helen, the council tenant to evict Helen from the Council property.
Okay - and is this an assured shorthold tenancy?
What type of tenancy is it? Do you know?
Can I apply for legal aid?
Okay - it wont be an AST from a council landlord.
And yes, you might be able to apply for legal aid.
Have you been in touch with solicitors yet?
There are different types of tenancy from council landlords, but whatever type it is, a possession order is required before anybody can be evicted.
No. There is not yet any court proceedings until the expiry of the NOTICE TO QUIT on 28 FEB 2013. Can Helen apply for legal aid now against BRENT COUNCIL and its TMO management office in Watling Gardens refusing to do anything in the bathroom to suit the disability of the council tenant, HELEN?
Yes, the service of the notice to quit is enough for her to apply for legal aid. to do this, she needs to find solicitors that offer legal aid. Do you know a firm?
I hope this answers your question. If you need further information, just let me know. Please do remember to rate my answer as highly as you can.
I do not know any law firm or any barrister doing such work. Please kindly refer to me a list of law firm that can do legal aid on this work. Do you do legal aid? Please kindly refer to me the name of law firm to approach for legal aid application. They can also instruct you to represent me with legal aid public funding.
We can't do this kind of thing, but it depends where you are etc as to who you might approach. I would suggest you contact the Law Society in the morning and ask them for firms in your area. They maintain a current list of all firms offering legal aid etc. Their website is: www.lawsociety.org.uk/
It is a secured council tenancy signed on 20 August 2010 in Brent Council. An original copy was given to the Tenant Management Office(TMO) of Watling Gardens. Miss Wish, the occupational therapist applied for me due to medical reason for a council house. It is a studio bungalow on the ground floor.
okay, they have to get a court order and show you're in breach to remove you.
Try and get legal aid tomorrow and get somebody acting on this for you asap.
Are you sure that the Law Society will give me a list of law firms offering legal aid for NOTICE TO QUIT for council tenant with secured tenancy on medical grounds? I live in London NW2 3UE.
Yes, they maintain a central registry of all firms in England.
