I want to divorce my Husband as we have lived apart for 3 years

Customer Question

I want to divorce my Husband as we have lived apart for 3 years in a civil partnership!
I appointed a solicitor in Southampton but she says unless he signs a paper saying he agrees I have to pay £2000 which I have not got -what do I do?

Hi
Thank you for your question.
I will do my best to assist you but need some further information first.
Is your ex likely to agree to a Divorce?

Can I divorce my civil partner through the civil court without representation?I understand there would be standard court costs.

The grounds for divorce would be desertion by him within 12 months of the ceremony in London.

How do I start the ball rolling? I understand there will be no further costs from yourselves

Hi
Then you have two options.
You can issue a Petition immediately on the grounds that your ex has behaved Unreasonably and hope that your ex does not defend it (its costs money to do so which may mean all will be well) - or you can wait another two years and issue a Petition based on the fact that you will then have lived apart for five years.
The Court fees come to just under £400.

I hope that this is of assistance to you
