Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return. For now please let me know did you appeal or pay the original PCN? I assume this is a Council penalty notice?
yes,i did not pay or appeal.
Did you know about the PCN? Did you get the Notice to Owner etc?
i got the court hearing letter which i could not attend
i did not get the PCN
Did you know about the Court hearing? Did you get a reminder? Did you get a notice to owner?
i knew about the court hearing by letter.the car i had at the time was a rental.so they contacter the rental company and i guess they gave them my details
So you never received the PCN or Notice to Owner?
my problem is not the PCN which i am happy rto pay but the bailiff charges on top of that are 200% on top of the initial PCN charge.
Did you notify the Court that you would not be able to attend?
no,i thought that you have to be present the date they offer you
bailiff charges £583.is this legal? - This is not going to be the answer you want, nor the answer I want to give you but I have a duty to be honest. Yes this is legal. This is because rates are set by the Government about what bailiffs can charge. They are known for being expensive. If you think they are too much you can apply to the Court to have the rates assessed, but if you lose this assessment then you would be responsible for the legal representatives of the bailiffs attending that Court hearing. But yes for £190 the rate they charge is not beyond normal.
so you advise me to pay for that too?
I am sorry to say yes.
i think this is so unfair....just for a parking ticket...
I agree it is - but sadly this is legal.
thank you very much for your help...
thanks for your time
