My girlfriend had 2 friends staying with her last year from abroad who came over for a few days to go to the Olympic's.
She gave them full use of her car.
She is sole proprietor of her own coffee and organic cakes company and sells her wares at markets and shows around the area.!
Friday's she does not venture out of her house as she bakes the cakes for the weekend and takes deliveries of coffee etc.
This particular Friday the Olympic torch was coming through Reigate Surrey so she made an exception to walk into Reigate with her dog to watch the occasion.
This day her friend had use of the car and they committed a speeding offence and were caught on Camera.
She received the notice of intended prosecution after they had returned home, at the time they were not stopped just photographed.
My girlfriend has no idea who was driving and the photograph is very poor, so you cannot make out who the driver was at the time.
The 2 friends also cannot remember who was driving at the time.
My girlfriend was summon to court where they put the case off until later in the year. Three weeks ago she returned to court and she received a 6 point penalty and a £1000.00. fine and banned from driving for 6 months for with-holding evidence by not disclosing who the driver was.
She needs her licence to carry out her work, to pick up ingredients and also to pick up various students she employs to help her at the events.
This seems to be a bit harsh and unfair considering she does not know who the driver was at the time.
What can she do if anything to get the decision reversed?

Did she name the two friends?

Also, can she really not say who was driving? You are anonymous on here so its safe to be clear with me. Its just that its not really very credible to say that you cannot say who was driving your own car.

Also, did she check that both were insured to drive her car and can she produce their insurance documents?
