Thank you. The answer is yes you can issue proceedings.
You must complete form N1 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf and take it to your local County Court. The Court will then issue the claim which the Defendant will be given a limited time to defend. If they do not then you can ask the Court to enter Judgment and you would also need to complete form N510 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n510-eng.pdf
