Customer Question

i have recently been through a bitter divorce,(adultry on his part many times) basically i was left with nothing after a 28year relationship, 22years married. my husband and i had 2 businessed, i was also owner/director. as im sure happens a lot he would not disclose any off his earnings meaning i had to get a barrester and go to court. i had no money what so ever and was unable to do this....i was also mede homeless and at 48years old was staying with friend and my father, sofa surfing. he states that the businesses were none profitable and he was not working or earning any money from them, i know this to be a lie but could do nothing about it due to my finances... anyway after 18months i signed the divorce papers, which he signed to say he had no assess apart from the equaty in our home and a small pension, he did not mention our businesses. the papers did say i could not claim anything other that half the home after divorcing my husband but i am wondering now if as he is up and working our two businesses again.(as i knew would happen)now i have signed do i have a leg to stand on as he did not disclose the businesses on the divorce papers? could i go to the small claims court?

Hi
Thank you for your question.
My name is Clare and I will do my best to help you but I need some further information first.
Do you mean that there was a final financial order made within the Divorce proceedings and sealed by the Court?

Well I'm not sure, it was agreed 50/50 split equity in our marital home in the end as he would not give info on businesses, just said he was not working or earning... This is just what he said he would do if I left him.... He did not disclose the businesses as assets on the divorce paper.

As he did not disclose them then I am wondering if I can still try and get what I have also worked hard for now I have a few thousand from my marital home? I had nothing before this, not even a roof over my head so had no option but to sign to say I would not claim maintenance but this is not maintainence, it's my businesses as well as his.

Hi
What is it that you signed - do you have a copy.?
When was the Decree Absolute granted?
Clare
Customer: replied 3 years ago.
I signed the absolute august 12th a and I signed to say I agreed to the split on the equity of the house as that is what was holing up divorce from him, he would not sign before this. The only things he said he has was a small pension and the home we both owned.

Hi
What kind of businesses are they?
Clare
Customer: replied 3 years ago.
One was logistics, moving stuff for bigger companies... With the profits from this we bought trident blasters, graffiti removal and such like.... I must ad that some how he removed me as director putting his brother in so they probably "voted me off" I was told....

What I am thinking is..... As he did not disclose that he still had the businesses on the paper work..... Even tho I knew he had them but could not come up with the money to prove it.... Could I now go via small claims as he lied about his assets?
