Thank you for your question. My name is Jo and I will try to help with this.

-Could you explain your situation a little more?

For Jo C. The premises are industrial warehouse, at the moment empty. I contacted rates mitigators, who charged their fee, and introduced a company , "Suspended Coffee Company Ltd ", as "ShortHold tenant. I advised that Rates are not payable by me, as the premises have been taken on a "ShortHold Tenancy", by the above company. Counclil accepted my plea, and cancelled the rates Liability, except a small ammended bill , which was paid by me, however, they casme back to me after 4 weeks, and said, that Rates are payable by my, as the premises are empty. I replied, that premises, empty, occupied or part occupied, it is the responsibility of the Tenant company, how it nwant to use the premises. Council has since,. maintained, that Rates liability mhas been reverted back to us, and should be paid, and have issued final notice.

  1. I have been asked to look at this. Do you have a written lease agreement with the tenant please - whether it is a business lease, tenancy at will or so on?
  2. What is the term of the tenancy?
  3. Is the property empty - i.e. has the tenant moved out?
  4. Are they still paying rent?

FYI - I have to step into a meeting for half an hour but with your permission shall revert to you on my return if you can clarify the above for me?
