Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
Does he have any previous driving related offences please?
none. he passed his test on 7th july of this year
I see. Then he can expect a fine. The disqualification is from 12 months and 16 months with a reading of 108-83 - so this is around the middle.
I would suggest perhaps 14 months. There will also be costs of the Prosecution of about £85 and a Victim Surcharge of about £20.
However he can ask for a reduction in disqualifcation of 25% by taking the drink driver course and he should do that.
Can I clarify anything for you about this today please?
So he will definitely get banned although it is his first offence?
For sure, the Court has no discretion whatsoever
And its a 12 month minimum ban (less any drink driver course reduction).
