How do I prove ownership of a segment of my mothers land which

Customer Question

How do I prove ownership of a segment of my mother’s land which was left out in error when the remainder was first registered? The first registration with UKLR was after my father died and a part was sold. The ownership of the remaining property less the segment was registered to myself and my mother 50% each.

Hi there,

Do you have the unregistered title to the segment of land that was not registered? (I'm guessing not).

Does it form an integral part of the property and is the land fenced in within the physical boundaries of the property?

Thanks
AL

Yes the old form documents are available and wher used to first regerster

correctly the main plot.

The segment is next to the highway and forms a sight setback.

It has been established it is not part of the highway.

Hi again,

Thanks for your reply.

Was there a reason given by the Land Registry as to why they did not register this segment with the original application?

Thanks

AL

"For Aston Lawyer.."
Underdestress I and my mother singed a scketch which the solicitor should have known was incorrect excluding a segment. As he was in posesion of all the preregistation documentation which showed the preregitraFor Aston Lawyer.."tion owemnership which first regestered the remainder must have been correct.

Because this sector has not been first regestered with UKLR the Police, neioubores and solicitors are saeing that by dfult it is now common land.

So when was ownership removed by UKLR or whome.

Hi,

Thanks.

Just so I am clear, is the segment of land at the front of your property, between your front boundary line and the road?

Kind Regards

AL

Sorry for the delay, due to computer problems I had lost my outlook email address but are now OK.

The missing segment is part of our property and inside of the Highway as can be proved by Historical Title Deeds.

Hi again,

Thanks for your reply.

Have you asked a Solicitor to apply to the Land Registry to register the segment?

Kind Regards

Relist: Inaccurate answer.
Is it correct that property that has not been first regersterd with UKLR is in the ownership of the the person with the Historical Title (old stile Conveyances, abstrates of Title etc) and that ownership is not removed and it becomes Common Land as is being surjested. An atemp is going ahead to regester it with UKLR but it is taking a lifetime duev to a fery long Que. The proof in Law is needed that it has not changed from ownership to become Common land in resent time. I cannot understand why this shuch a problem solve without this being Regestered with UKLR.
