Ask a Law Question, Get an Answer ASAP!
Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
Have you complained to the Local Authority please?
No not yet. We would like to find out what are options are. It appears to me that the school are using/misusing the managed move arrangements so they can send him back if they don't like him. Thanks
You first need to complain to the school and see what they say. Make sure this is in writing.
If that does not resolve it then you can complain to the Local Authority. They fund local schools and will have a proper formal process for investigating complains and this may fix it.
The Council will investigate the complaint and report back to you.
If you are unhappy with the result then your next step is the Ombudsman.
They are further independent from the Council and can investigate the complaint further for you.
Their website is at: www.lgo.org.uk
Hopefully if you do the following then that should resolve it
1) Complain to Council
2) Complain to LGO
and of course this is assuming you have complained to the School.
Can I clarify anything about this for you today please?
I was hoping for advice on managed moves, their uses and implications. Whether we should accept a managed move etc. Your advice is generic.
Please remember this is a question and answer site and I can give you the legal position and steps to take. But the site is not intended to replace any professional advice you wish to seek and I do not have access to all of the evidence.
I can tell you what steps to take but I can not advise on whether to accept a managed moved as I have not seen all the papers and it would be wrong of me to make any assumptions and give you incorrect information.
I can tell you what steps to take from a legal point of view.
