i have not contributed to paying mortgage and have now retired and need to claim benifits but can not as i have equitey in property which i wish to give up

Hello,

Removing your name from the mortgage is not easy.

The other person should speak to the mortgage company to see if they will allow your name to be removed from the mortgage or the other person will need to try and get another lender to give a mortgage to them in their name only and pay off the current mortgage company.

The other option is for an application to be made to the court for an order for sale of the property so that when the mortgage is redeemed from the sale proceeds, your name will fall away with the mortgage.
