Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
Did you sign any terms and conditions? Which country are disputed governed by please?
I opened the account on the website and clicked the agree to terms and conditions button
I dont know which country law are they under, there office is in london, and they always call me from there
Yes I have checked , Ubinary is owned by PPT capital, The Chapel Reigate Road ,Leatherhead,SurreyKT22 8RA
Ubinary , main office is in London , international House.XXXXX london E3 2SJ
They always take authorization for big trades
But they did not this time?
One person was trading in my account , he ussally speaks to me and trades, I had very special instruction to him to trade slow and safe , this time he went on leave and handed over the account to some body else, the other person did not even spoke to me that how I want to trade, and trade huge volume in just single day resulting in loss of all my money
You have this in writing?
no, how can I have this in writing
You need to write and set out your losses and request a refund within 14 days or say you will go to Court within 14 days. You should make sure you send this recorded delivery and keep a copy.
If they do not refund you then you can issue proceedings in the County Court. You can either do this online at: www.moneyclaim.gov.uk (you may not be able to use this if you are abroad) or by completing form N1 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n001-eng.pdf and take it to your local County Court.
The Court will then issue a claim which a copy will be sent to the Defendant who will have a limited time to defend it, if not you can enter Judgment and enforce.
If the matter is defended it will be set down for a trial. If the claim is for £10,000 or less it will be a small claim and you will not need representation. If your losses are more than £10,000 as the matter is defended you will need legal representation to prepare your case and represent you in Court. Further you would need to attend any hearing.
Can I clarify anything for you about this today please?
if I cannot do it on line then how can I do that
I dont know whether you can because you are abroad. I assume you can
But the Company has to be based in the UK
If not you need to instruct a Solicitor here to issue proceedings for you
can you do it for me
Sadly not - its against site rules
can you suggest any names, or what type of lawyers
If you go to: http://www.lawsociety.org.uk/find-a-solicitor/
This can give you a list of Solicitors that can assist.
But check Moneyclaim first, I think you can issue if you are abroad if the Company is based in the UK
Can I clarify anything?
thanks a lot
