Alex Watts :

Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.

Alex Watts :

Was this the first hearing or did you plead not guilty please?

Customer:

i pleaded guilty, but the judge wanted to see the cctv

Alex Watts :

Ok - so it has gone off for sentence?

Customer:

so they have to get it,i havent seen it when being interviewed

Alex Watts :

Or adjourned for the Judge to look at the CCTV for sentence?

Customer:

no just ajourned for cctv and he wants a probation report

Alex Watts :

Ok - then the Solicitor would have gone through the statements

Alex Watts :

However you will be sentenced on your version of events and based on what the CCTV shows

Alex Watts :

Witnesses often are mistaken as to the details.

Alex Watts :

But the Judge will sentence you on your version and take into account the CCTV

Alex Watts :

Can I clarify anything for you about this today please?

Customer:

the injuries wear a thick lip and 2nd male said i hit him but no injury,on the police report they say i hit one and lunged at another.

Alex Watts :

Ok - the CCTV will show all

Alex Watts :

But if that is not available you will be sentenced on your version of events

Customer:

in the statements it says male 1 was unconsuse,do they need medical proof of this

Alex Watts :

Did you plead guilty on a basis?

Customer:

yes i did

Alex Watts :

I assume this was accepted by the CPS?

Customer:

yes

Alex Watts :

If so then you will be sentenced on that written basis so it makes no difference what the statements said

Alex Watts :

You will be sentenced on the written basis agreed

Customer:

i only pleaded guilty as the police said it was on cctv

Alex Watts :

You have pleaded guilty on a basis and you will be sentenced on the basis agreed.

Alex Watts :

Can I clarify anything for you?

Customer:

yes please dont under stand basis agreed

Alex Watts :

You said you pleaded guilty on a basis which was accepted by the CPS

Alex Watts :

This is a different version to what is in the statements. That means the Judge will sentence you on YOUR version of events

Alex Watts :

Not on the CPS version

Customer:

ok thanks

Alex Watts :
