Can I use a company business name if it already registered

Customer Question

Can I use a company business name if it already registered with company house. I did register the domain name before the other person registered his business name. The other company appears to not be trading as they have no listed telephone number that I could find listed to the name I have brought as a domain.

Thank you.

It seems that this company was incorporated very recently in August 2013.

As you registered a domain name before this company was incorporated, I would advise you to complain to the Company Names Tribunal as the company may have been incorporated to prevent you from registering it or to get money out of you.

See here for information about this: http://www.ipo.gov.uk/cna/cna-factsheet.htm

The adjudicator has the power to order the company name to be changed or choose a different name for the company, leaving you free to use the name which you have already registered your domain under.

All the best
