I have paid a court claim that was issued to my company but the claimant has not notified and refuses to notify the court that this has been paid. It has now settled as an unpaid CCJ and our bank account is on the verge of being revoked due to poor credit. What can I do?
Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return You do not need to wait here as you will get an email when I reply.
Have you got proof of payment please?
Not with me here, it's at my office on bank statements
But you have evidence though generally?
If so take it to the Court (or post it) with a covering letter showing the date of CCJ and date of payment
The Court can then either:
1) issue a certificate of CANCELLATION if it was paid within 1 month of the CCJ, or
2) issue a certificate of SATISFACTION if paid outside a month
You can then send this certificate to Experian, Call Credit and Equifax
They can then either remove or mark as satisfied the CCJ
The cost of this is £15
Can I clarify anything for you about this today please?
The payment was made within one month of the CCJ, not of the date the claim was received, does this still qualify for cancellation?
Yes it does
It still costs you £15 for the certificate
But it will then be removed when you send it to the credit reference agencies
Does that help?
Could you point me in the direction of what forms I need to send and where to send it to? The claim was originally done via the moneyclaimonline service
Ok - no forms you fill out.
You need to send it to Northampton Bulk Centre
Copy statements in that case not originals.
What do I send? A letter explaining and copy the statements, highlighting the payments?
Is there where I send it? 4th Floor, St Katharine's House, 21-27 St Katharines St, Northampton NN1 2LH
Thats the one
Perfect. You have been very helpful. Thanks
Can I counter claim?
for damages to credit rating?
No. Because he is just being a pain in the bum
You can't really claim for that as inconvenient as it is
But what if we loose our merchant facility over it as they threatened today?
Possibly you could have a claim, but not unless you lose it
Unfortunately, I think we might
Explain its cancelled and ask them to wait a month
Once you have the certificate of cancellation you can send it to them
I tried today but they were not really interested. I will send the information to the courts and see where we go from there
Can I help with anything else?
No, thats great thanks very much
