Ask a Law Question, Get an Answer ASAP!
Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
What offence were you charged with please? What sentence did you get?
Shoplifting and a straight fine, with no strings. I wasn't bothered about helping her out because I am english and had no intention of leaving the country. I have married an American citizen 7 years ago and now she wants us to move to the USA, I was checking the requirements and I need a police certificate to get a green card to live there permanently.
Its bad news I am afraid.
If the conviction is accurate sadly you can not get it expunged.
However given the age then it may not be recorded on the Police National Computer.
I would write to the Police and ask for a copy of your PNC, then you can see what is showing.
If it does not show then you have nothing to worry about.
If it does show, given that you only received a fine and it was 25 years ago it may be disregarded.
Clearly as a UK Solicitor I have no knowledge of the USA immigration process./
But try your PNC and if it does show it may be disregarded anyway given the age.
I am sorry if this is not necessarily the answer you want and certainly not the one I want to give you, but I have a duty to be honest
Can I clarify anything for you about this today please?
I have been on the police website and looked at the forms to get a certificate and it asks if you have ever been arrested cautioned or charged. If I answer no is that a crimminal offence to get a certifice under false pretences.t
Technically it could be fraud.
