Resolved Question:

I want to evict a commercial tenant. My bookeeper has just finalised last years accounts and there is a bounced cheque for rent in may 2013 also no bank payment for October. I don't remember him making these payments up. Can I evict him for nonpayment of rent. What would happen if it later transpires that he did make them at a later date ?

you can evict for non payment of rent

Matt Jones :

it is called forfeiture. if it transpires he did make the payment he would have to apply to the court for "relief of forfeiture" to reinstate the lease
