Hello and thank you for your question. I will be very pleased to assist you. I'm a practicing lawyer in England with over 10 years experience.
May I ask if you have suffered any financial loss from the disclosure please?
HelloI havent suffered any financial loss but I have been constantly contacted by companies on both my land line and mobile. This has waned slightly over the year since the accident.
Thanks. I am sorry to hear of your circumstances. Based on what you say the company is in breach of its obligations under the Data Protection Act and common law to keep your information safe.
From what you say they have failed in their obligations in this respect.
Accordingly you have grounds for a claim against them.
How would I progress this?
The simplest way to raise a claim is to consider using the Financial Ombudsman Service. Their service is free of charge and their decisions bind the insurer. To use the service you first need to raise a formal complaint with the insurer directly setting out the issues you have suffered as a consequence and requesting compensation
thanks for all your advice this is a great help!
You may wish to propose a figure based on the amount of time wasted and the potential damage the exposure of the information could cause in terms of risk of identity theft.
How would I come to such a figure?
If they are unwilling to offer you an amount you are satisfied with you can then escalate the matter to the Financial Ombudsman using the following link:
Thanks again for all your help with this, very happy!
