Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply, but rest assured I will be giving your question my immediate attention upon return You do not need to wait here as you will get an email when I reply.
Do you rent or own it please?
It is a flat, I own it, not rent it. The repossession was for unpaid maintenance charges not mortage arrears.
Did you not get notice of hearing?
Yes. I realise I have been completely stupid but I have ignored all letters and phone calls.
Ok - you need to apply for relief
Hold on let me get the forms
You need to complete that and send it to the Court.
The Court will then list the matter for hearing and decide whether to grant relief
What does this mean please?
Obviously you need to do this asap
You are asking that the court order you get the flat back
It will upon payment of any arrears over a period of time
Does this mean I may be able to keep it?
You may be able to yes
It depends on whether you can pay the arrears
Can I clarify anything for you about this today please?
Yes, I can get the money to pay. In the meantime, I need to get access to the flat for clothes, medication etc...is this going to be possible?
No, not until you get relief or the Landlord lets you
Which he may under supervision
Would the landlord be the solicitors or the mortgage company?
The Landlord Solicitors
So they would let me back to collect some belongings tomorrow possibly? How long before I can get a court hearing do you think?
Possible they would let you back in
As for Court, I can't say it all depends on listing and how busy they are.
When you make the application say you have been evicted from your home - I would hope therefore it would be quick
Ok, is there anything else I need to know?
Can I take the form in person to the court?
Fill out the forms and take them to the court tomorrow
So if I get a hearing as soon as possible and pay immediately, it may be possible to take back possession?
Yes or pay over a period of time is also possible
Ok, thank you very much for your help, it is appreciated.
