I would suggest that you first check with your solicitor what the deeds say. If the covenant is to repair rather than replace then your neighbour is correct and you should get a 6 ft fence put up and it should not encroach on his boundary.

I suggest that you reply to your neighbour and say that you are seeking legal advice after which you will see what to do about the fence. In the meantime, you should make sure that it does not encroach on your neighbour's boundary.
