Is it legal for a past employer to open the personal mail of

Resolved Question:

Is it legal for a past employer to open the personal mail of a previous employee that is addressed to the employee personally at her home address.  The house in which the employee lived is owned by the employer and the employer is aware of her new address which is on the same estate.  The employer is not only opening the mail but writing 'gone away' across the envelope when they know this is clearly not the case.

It is an offence under the Postal Services Act 2000.

S. 84 (1)A person commits an offence if, without reasonable excuse, he—
(a)intentionally delays or opens a postal packet in the course of its transmission by post.

S. 84 (3) provides that "A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him."
