Alex Watts :

Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.

Alex Watts :

Do you have a tenancy agreement with him please?

Customer:

no as its family, my sister but my dads land, i am askim

Customer:

this question on behalf of my dad as he is 90yrs old and lost his sight.

Alex Watts : I see.
Alex Watts : They are wrong,
Alex Watts : They never get a right to the land.
Alex Watts : You always own it. They can never take possession.
Alex Watts : There is a thing called adverse possession.
Alex Watts : But for this they need to occupy for 10 years and make an application to the land regsotry.
Alex Watts : The land regsistry would then notify the owner who is able to object. I assume you would.
Alex Watts : If you do the applicTion fails.
Alex Watts : But they don't have a right to land.
Alex Watts : I hope this reassures you,
Alex Watts : Can I clarify anything for you about this today please?
Customer:

Thanks for that, so is my dad within his rights to ask her to sign an official paper to agreement that if and when she has to vacate the land she must do so without any problems.

Alex Watts : Yes that is fine.
Alex Watts : But you don't need to worry.
