N181 – Disclosure of documents. I intend to list all documents

Customer Question

N181 – Disclosure of documents.
I intend to list all documents that I have issued to the defendant and include the documents that I would like to see form the defendant. i.e. a list of the documents that I believe the defendant should be able to produce if he has indeed done what he said he would do. This also includes proof by way of sight of bank statement of financial transactions. The bank statement is that of a registered company of which the defendant is the sole director. The funds within the company are however solely those of the claimant and so there are no other third party confidentiality issues. Is asking for sight of a detailed bank statement reasonable?
Also ……. Can a transcript of a voice recorded meeting be included as a disclosure? The defendant did not know the recording took place.

No, just that N181 - D4 asks what directions are proposed for disclosure?

Alex Watts :

In that case you don't list all the documents,

Alex Watts :

Just put you want the standard directions for disclosure and inspection

Alex Watts :

Dont put anything else.

Alex Watts :

Disclosure happens after allocation to track and directions given

At the appropriate time for disclosure can a transcript of a voice recorded meeting be included as a disclosure? The defendant did not know the recording took place.

Expert:  Ash replied 3 years ago.
You would need to include that on a disclosure document.
