What is the history of the matter - what are you trying to achieve?

The variation allows my stepfather to live in the property left to myself and brother rent free for the rest of his life. He has only just turned seventy and could live for another twenty years or so. I am currently renting and wanting to buy but have no capital and wish to either sell the property or live there but not with my stepfather.

It was in 2009. At the time we wanted to give my stepfather some security now that he was on his own, believing that he would move on at some point. He has 2 properties in Spain at which he resides for most of


the year.

I doubt it. He was the one that wanted to vary the will in the first place. If he does not is there any legal way of counteracting the deed of variation?

There is no way of altering the provisions which were made when the Deed of Variation was signed unless ALL parties agree and from what you say this will not happen
