Did you go into their offices and sign the contract please?
your website sys that
my e-mail addresss is already in use by another person i am [email protected]
no i signed it at the property
i need an answer please, its urgent
Yes I understand
I will answer now
What does the termination clause say on the contract?
if i terminate before the end of the minimum period, i agree to pay to hb a termination fee of £295+ vat if paid within 7 days of withdrawal otherwisea fee of £395. +vat becomes due as compensation fot their time and
cost. i a
m willing to pa
Right its bad news
y the get out fee
As you signed on their premises then you have NO cooling off period
This means you can only terminate in accordance with their contract.
If the contract states you are liable for a fee then sadly you are
However you give instructions so you can say how much you want to market the property for
However it may be possible in that if you say that you are suspending marketing, rather than withdrawing it, no fee may be due
You need to see what the terms and conditions say about that, suspending.
But sadly if you cancel then they are due a fee
But they can't dictate what the selling price is
Can I clarify anything for you about this today please?
i understand and i that am willing to pay. i think forfeiting £400+ is better than losing £20,000. can they insist that i cannot cancel
You can cancel if the contract allows you
And from what you have said, it does allow you
Therefore you can write, set out your position and pay the fee
If they want a higher fee, they can try and take you to Court
But a Judge will look at the contract too and see what it says
it says it can be terminated at any time by either them or myself, immediately
There you go then
but can they insist i continue with the sale?
If you cancel the contract they can only claim the fee as per the contract
oh thank you very much anne webb
Can I clarify anything else?
not at the moment thanks, XXXXX XXXXX how i get on with my fight i may be back to you.
