Yes indeed, that is my neighbours fence. After this winter both his and our fences were down and we fixed ours as per the hight it used to be before being damaged but my neighbour put a 146 cm fence motivating that is better and the wind will not destroy it in tge future. Moreover, from half up of its fence is c trugh and on one side the fence is less than 100 cm
Its bad news I am afraid
The neighbour does not have to build it back to a certain height.
Indeed he could remove the fence all together and not replace it
If it is his fence then he is responsible.
He can have it as high (within reason) or as low as he wants
