Hi AJ thank you for your reply. They tried and failed to win compensation, informing me over the telephone but did not confirm it in writing as was the correct procedure. while this was going on i believe the letter of authority had already expired,and was never seen by the bank during this time either because of that, or they had lost it. they tried to get me to sign a new letter of authority 3 days before i settled with the bank, which i did not do. i have it in writing in a letter from the claims management company stating the letter had expired. i complained to them and they reduced my alleged bill to £2,000, but sent a debt collecting agency the amount of £3,833.76 which is the original amount plus interest, which i know is in breach of the Complaint handling rules 2006.
I believe i was quite within my rights to settle the claim myself, the told me 12 weeks for a decision, 18 month later i settled it, i believe i was out of contract with the company when they told me they had failed, and because of the duration of time their L.O.A. had expired.
