SO, DO APPLY IN THE NORMAL WAY USING FORM 244 BUT GIVE A GOOD EXPLANATION AS TO WHY THE DELAY IN APPLYING. IS THEN A MATTER FOR THE JUDGE TO DECIDE IF THERE IS JUSTIFICATION TO SET ASIDE? what i am really asking is whether there is a mechanism for this process?

There will be a hearing and a Judge will decide.
