Ask a Law Question, Get an Answer ASAP!
Hello my name is Alex and I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
Do they have an idea of when this happened please?
I assume they do , but will not share it with me ,therfore i cannopt prove it was not me .
If they do charge you they can have a date range, so for example in between 1/1/2014 and 12/5/14
But they would need to prove the offence took place between those dates.
Obviously the exact date is ideal but they can use a range
Can I clarify anything for you about this today please?
They have not charged me , they only said dont do it again,or i will be charged .
Yes. If you have done it then this is just a warning then I would take heed.
This is because if it happens again they could charge you and that could land you in more trouble.
Does this clarify the position?
no , as i want to clear my name
But a warning isn't a charge
You can get a warning retracted as such
Because its not a conviction.
Therefore its not like the same thing
You can refuse to accept the warning and you could be charged.
But a warning is not a conviction or a caution
It expires after 1 year
I have been in hospital with a stroke , and had bad health for three years ,i seldom leave my home .I would like to clear my name .
Ok - refuse to accept the warning
And you could be charged.
Then it would go to Court.
If you are found not guilty,. your name is cleared
If you are found guilty then you stand convicted.
But refuse to accept the warning
Does that clarify how you can clear your name?
no , but thank you
If it does not clarify, how may I assist to make it clearer? Which part do you not understand and I can clarify
Can they be forced to tell me the exact date .
They can give a range as I have suggested.
Ideally a date should be given
But the person may not remember the exact date, but therebaout
therfore if was 100 miles away , i would still be charged .
Yes you could be. Harassment is not just physical.
It could be texts, calls and even silence can be harassment
Thank you for your time .
