Hello, I am a joint owner of a property held as Tenants in

Resolved Question:

Hello,
I am a joint owner of a property held as Tenants in common with Party A.

I wish to achieve the following without Party A becoming aware.

1. To transfer my ‘share’ by way of a gift, to my two adult children jointly (as Tenants in Common?)

2. The transfer being contingent on

(a) that the transferred title may not be sold during my lifetime other than at my express, formal request

(b) that the property being sold in accordance with my express, formal request

How can this be best achieved, please?

When needs to happen is you need to set up a trust which will recognise the two adult children as the real owners, but you will continue to hold the paper title to the property.

You can also make it a condition that their interest is not to be disposed of without your express consent.

tdlawyer :

You will need to sit down with a private client (or tax and trusts - as their often called) lawyer to draw up the necessary trust documents.
