Our tenants left our property september 2013 and left behind 2 sofas, they are now asking for them, what are our rights please

Yes we still have them, they are being used by the current tenant

Okay, and did you serve a formal notice under the Torts of Interference with Goods Act 1977 requiring the goods to be collected by them?

Customer:

No, they moved in with my son and before we could get them to sign anything they went on holiday with contributing any money, I wrote them a letter asking them to leave which they did and my son informed them that he would get rid of the sofas if they didn't collect, that was 9 months ago and we haven't heard anything from them since. Until today

Okay. To require somebody to collect their goods from a property, you have to formally serve notice under the 1977 Act I mentioned. It has certain formal requirements, so simply telling somebody to collect doesn't impose an obligation upon them to collect.

This means that they would be entitled to collect them now, from you.

That is, unless there was an agreement between you that they would collect them.
