Hello my name is XXXXX XXXXX I will help you with this. Please note that I am a working Solicitor and may be on and offline as I have to attend Court and meet with clients, even at weekends. As such you may not get an instant response when you reply as this is not an ‘on demand’ live service, but rest assured I will be giving your question my immediate attention upon return. There is no need to wait here, you will get an email when I reply.
But why have they refused to supply this?
I stated that as the outcome of surgery was unsatisfacory therefore i would like to refunded for the cost of surgery only, enabling me to pay for further reconstructive surgery. Explained that my new surgeon requires letter of discharge before commencing any consultations Harley medical stated that they have never been in this situation and that along with my written complaint this would take some time and that the clinic manager and surgeon who is not due back untill June would need to sit down together and put a case together. As i understand it from a hospital perspective patients can and do discharge themselves with an immediate discharge letter ? I would like to resolve this matter as soon as possible so that i can move on with a view to booking further surgery at the end of the year or early next year.
Legally where do i stand on this matter ?
Also there is nothing stated in their terms and conditions on patient self discharge !
There is know mention of or reference to patient letter of discharge or patient self discharge
In fact on speaking with the clinic mamager Katie who stated she had never come across this before ! and would need to contact her head office, I assume then that they do not have a policy on patient self discharge ? which i thought they would need for CQC compliance ?
I would write and demand a letter of discharge in writing.
Say if you do not get it you will issue proceedings in the County Court.
Give them 14 days to respond and make sure you send the letter recorded delivery
If they do not refund you then you can issue proceedings in the County Court. You need to complete form N208 http://hmctsformfinder.justice.gov.uk/courtfinder/forms/n208-eng.pdf and take it to your local County Court.
The Court will then list the matter for a hearing and decide whether the Hospital should provide the letter
I am sure when you issue proceedings this will prompt them in supplying the letter
Can I clarify anything for you about this today please?
Thank nyou Alex for you time and help.
